1. General

The pigmenta.ee online store (the Store) is operated by Kreative Digital OÜ (Estonian business register code 14201185), registered at Rüütli 38, 3rd floor, Pärnu, 80011, Estonia. The Store trades under the brand Pigmenta.

These terms of sale apply to every contract of sale concluded through the Store. Placing an order means you have read and accepted these terms.

Pigmenta may amend these terms unilaterally and will publish any changes in the Store. The terms in effect at the moment you placed an order remain binding for that order.

2. Products and prices

Prices of prints sold in the Store are shown next to each product and are quoted in euros, VAT included. Delivery to a parcel locker costs €2.90 per order and is free for orders of €25 or more; collecting the order yourself from our Pärnu office adds no charge.

Orders over €25 ship free. Volume discounts (5% from 10 prints, 8% from 25, 12% from 50) apply automatically in the cart based on your total print count, regardless of size.

Product descriptions, available sizes and paper finishes are shown next to each product in the Store. Colour accuracy depends partly on the quality of the file you upload (see section 7).

3. Placing an order and contract formation

To place an order, you upload photo files, choose sizes, quantities, border style and finish (glossy or matte), pick a parcel locker, and enter your contact details (name, email, phone).

The contract of sale is concluded the moment your payment is received in Pigmenta's bank account, or the payment provider confirms your bank-link, card or wallet payment. An order confirmation is then emailed to you.

If, for a justifiable reason, we cannot produce your order (corrupted source file, technical failure, force majeure), we will notify you as soon as possible and refund any amount paid within 14 days.

The following payment methods are available:

• Bank transfer — we email an invoice with a reference number. Production begins once your payment lands in our account.
• Payment provider AS LHV Pank (LHV Paytech) — bank links (Swedbank, SEB, LHV, Coop, Luminor and others), Visa/Mastercard, Apple Pay and Google Pay. Payment happens in the provider's secure environment; Pigmenta never sees or stores card details.
• Gift card — a Pigmenta gift-card code can pay for all or part of an order (shipping included); any remainder is paid by one of the methods above.

4. Delivery

Pigmenta delivers prints to parcel lockers in the Omniva, Smartpost (Itella) and DPD networks across Estonia. You choose the locker at checkout.

You can also collect your order yourself from Pigmenta's office (Rüütli 38, 3rd floor, Pärnu) during office hours, free of charge. We email you when the order is ready for collection; the office is not a shop, and there is nothing to collect without a paid order.

Orders generally arrive at your locker within 2 working days of the contract being concluded. Large orders (100+ prints) may take 1–2 working days longer; we notify you by email if so.

In exceptional cases (force majeure, courier outages, seasonal load) Pigmenta may extend the delivery time up to 14 calendar days, notifying you without delay.

Parcels are kept in the locker for 7 calendar days. We cannot automatically retrieve unclaimed parcels — please watch for the locker code we email you.

5. Right of withdrawal and returns

Important: Pigmenta prints are goods made to the consumer's specifications and personalised within the meaning of § 53 (4) (3) of the Estonian Law of Obligations Act. This means consumers do not have a 14-day right of withdrawal on distance contracts — orders cannot be returned or exchanged once production has begun.

Production starts as soon as your payment is received. If you wish to cancel before production begins (typically within an hour of payment), email info@pigmenta.ee immediately. We will refund the full amount paid.

The right of withdrawal does not apply to orders placed by legal persons (B2B).

6. Complaints and quality guarantee

Under § 218 of the Estonian Law of Obligations Act, Pigmenta is liable for two years from delivery for defects that originate with us. These include a paper or material defect, a printing error, inaccurate colour reproduction on our side, mechanical damage in transit, and any mismatch with the ordered size, paper or border style.

If a print has such a defect on our side, contact us within 2 months of noticing it: email info@pigmenta.ee with your order number, a brief description and a photo of the defect. Once we confirm it, we reprint at no cost or refund the amount you paid. Pigmenta decides within 15 days of receiving your complaint.

What the guarantee does not cover. Every print is produced exactly from the file you upload (see section 5), so a result caused by the source file itself is not a defect — for example low resolution or DPI, a blurry, out-of-focus or over-exposed photo, a wrong crop, an incorrect colour profile saved in the file, or filters you applied. A print that faithfully reproduces a low-quality source file is not defective, and in those cases there is no free reprint or refund. See section 7 for more on source-file quality.

Cutting accuracy. Prints are cut by hand. The finished print may therefore deviate from the ordered size by up to 1 mm; such a deviation is not a defect and is not grounds for a claim.

Framing. When a photo's aspect ratio does not match the chosen format, the Store fits the image to the paper automatically — cropping from the centre, zooming where needed and rotating according to the file's orientation. Before ordering you can adjust the framing of every photo yourself in the editor (the pencil icon). If you do not adjust it, the automatic framing is deemed accepted, and no claim can be based on our cropping, zooming or rotation of the photo.

Pigmenta is also not liable for damage that occurs after the parcel has been handed over to the locker or to you (rain, prolonged sun exposure, careless handling).

7. Source-file quality and limits of liability

If you're unsure whether a file is suitable, email us at info@pigmenta.ee before ordering. Pigmenta may always accept an order and notify you before printing if a file looks unlikely to yield a satisfactory result.

• low source-file resolution or compression artefacts
• the user's uncalibrated monitor, phone or tablet (the colours you see on screen may not match the print)
• filters applied by the customer that reduce colour gamut
• incorrect colour profile metadata in the source file

8. Copyright and content responsibility

By placing an order you confirm that you have the right to use and print the uploaded photos — that is, you own the copyright, have the consent of any people pictured, or hold any other necessary permissions.

Pigmenta does not verify content copyright and is not responsible for third-party claims arising from files you upload. Any such claims will be directed straight to you.

Pigmenta reserves the right to refuse to print and to cancel an order if it contains illegal content (e.g. child sexual abuse material, hate speech, incitement to violence). In such cases we refund the full amount paid and notify the competent authorities if the law so requires.

9. Personal data

Pigmenta processes your personal data in accordance with the General Data Protection Regulation (GDPR) and the Estonian Personal Data Protection Act. The categories of data, the legal bases for processing, retention periods and data-subject rights are set out in the Privacy policy.

We only send direct marketing offers (newsletters, campaigns) if you have given your explicit consent. You can withdraw consent at any time via the unsubscribe link in any email.

10. Dispute resolution and governing law

Disputes always start with a direct conversation. Email info@pigmenta.ee or call +372 636 0994 — we reply within 5 working days and try to resolve things by agreement.

If we can't reach agreement, consumers can refer the dispute to the Consumer Disputes Committee (komisjon.ee). Filing a complaint is free.

EU consumers can also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

These terms are governed by the law of the Republic of Estonia. Disputes involving legal persons are settled in Harju County Court.

1. Controller and scope

This privacy policy describes how Kreative Digital OÜ (Estonian business register code 14201185, registered at Rüütli 38, 3rd floor, Pärnu, 80011, Estonia), hereafter Pigmenta, collects, processes and stores personal data of visitors and customers of pigmenta.ee.

The data controller is Kreative Digital OÜ. For data-protection questions, contact info@pigmenta.ee.

We process personal data in accordance with the EU General Data Protection Regulation (GDPR), the Estonian Personal Data Protection Act and the principle of data minimisation — we only collect what we genuinely need.

2. What we collect

When you join the waitlist we only collect your email and, optionally, your first name. You can leave the waitlist at any time via the link in any of our emails.

• Identification data: first and last name (where needed)
• Contact data: email address, phone number
• Delivery data: the parcel locker you choose (Omniva, Smartpost, DPD)
• Order content: uploaded photo files, chosen sizes, quantities, finish and border style
• Payment metadata: order total, payment status, payment method. Card details and bank-transfer details are not stored by Pigmenta — they are handled by our payment provider AS LHV Pank (LHV Paytech)
• Business customer data: company name, business register code, VAT number where applicable (for B2B invoices)
• Technical data: IP address, browser type, device type, time zone, referrer — needed for security and service operation. When a cart is created we also store its IP address and browser identifier with the order, so abuse or unlawful content can be traced afterwards
• Order-tracking data: status updates returned from the payment provider and the courier (payment received, parcel in transit, ready for pickup, etc.)

3. Legal bases for processing

We process personal data on the various bases set out in GDPR Article 6 (1):

• Performance of a contract (Art. 6 (1) (b)): placing the order, delivery, customer service, accounting
• Legal obligation (Art. 6 (1) (c)): retention of orders under accounting law, VAT reporting
• Legitimate interest (Art. 6 (1) (f)): service security, fraud prevention, anonymous analytics, analysing usage patterns to improve the service
• Consent (Art. 6 (1) (a)): setting analytics and marketing cookies, direct-marketing emails, waitlist sign-up

4. Uploaded photo files

Your uploaded photo files are at the heart of the service — we use them only to fulfil your order (printing and packing). Files are stored on Hetzner Object Storage, an S3-compatible server based in Helsinki (Finland, EU); uploads happen over an encrypted HTTPS connection.

Pigmenta does not use your uploads for any other purpose — we do not publish them, share them for advertising, use them to train AI models, show them to other customers or use them in marketing.

Retention: uploaded files are deleted no later than 14 days after the order has been dispatched. Order metadata (quantities, sizes, totals) is kept for 7 years under accounting law.

If we have reason to suspect copyright infringement or illegal content (e.g. violence, child sexual abuse material), we may retain the files for longer and notify the competent authorities under applicable law.

5. Sharing with third parties (processors)

We do not sell, rent or otherwise broker personal data to third parties for marketing or any other purpose. We do not share data with any data brokers or ad networks.

• Hetzner Online GmbH (Germany / Finland) — server hosting, photo-file storage (Hetzner Object Storage, hel1)
• AS LHV Pank (Estonia) — the LHV Paytech payment service: bank links, card payments, Apple Pay and Google Pay; acts as an independent controller under its own privacy policy
• Omniva, Itella (Smartpost), DPD Estonia — parcel-locker delivery; receive the data needed for the order (recipient name, phone, locker)
• Shipit24 (shipit24.eu, Estonia) — booking and labels for Smartposti and DPD parcels; receives the recipient's name, phone number and chosen locker
• Cloudflare, Inc. (US, with EU data centres) — traffic proxying, DDoS protection and caching; sees the IP address of every request
• Functional Software, Inc. (Sentry) (US) — error monitoring; personal data is filtered out before reports are sent
• Our accountant and the e-arveldaja service (Centre of Registers and Information Systems, RIK) — registering sales invoices in the books; an invoice carries the buyer's name, contact details and order contents
• Resend, Inc. (US) — email delivery for order confirmations and transactional notifications; Resend Audiences for managing waitlist sign-ups
• Twilio Inc. (US, with EU subsidiary in Ireland) — Twilio Voice for the inbound phone line
• Google Ireland Limited — Google Tag Manager and Google Analytics 4 anonymous analytics (consent-based only; see cookies policy)
• Google Ireland Limited (planned) — Google Ads conversion measurement (consent-based only)
• Meta Platforms Ireland Limited — Meta Pixel and Conversions API for measuring advertising campaigns; consent-based only, and only while a campaign is running
• OpenAI Ireland Limited — OpenAI Pixel and Conversions API for measuring ChatGPT advertising campaigns; consent-based only, and only while a campaign is running

6. Retention periods

• Uploaded photo files: up to 14 days after dispatch
• Order data (invoices, accounting): 7 years (Estonian Accounting Act § 12)
• Customer-service conversations (email, call recordings): 2 years
• Waitlist email addresses: until launch + 6 months, or until you unsubscribe
• Direct-marketing consent: until withdrawn
• Web and server logs (IP, requests): 90 days (for security and fraud prevention)
• Cookies: depends on the cookie type; see the cookies policy

7. Your rights as a data subject

On the order-tracking page (/track) you can download your order data in JSON format and start a deletion request. For other questions, contact info@pigmenta.ee — we respond within 30 days.

If you feel we have processed your data incorrectly, you have the right to lodge a complaint with the Estonian Data Protection Inspectorate (aki.ee) or another competent supervisory authority.

• Right of access — you can ask for a copy of the data we hold about you
• Right to rectification — if data is inaccurate or out of date, you can demand correction
• Right to erasure ("right to be forgotten") — you can request deletion, except where the law requires retention (e.g. the 7-year accounting period)
• Right to restriction of processing — you can demand a temporary pause
• Right to data portability — you can receive your data in a structured, machine-readable format (e.g. JSON) for transfer to another service
• Right to object — you can refuse processing based on legitimate interest (e.g. profiling)
• Right to withdraw consent — where processing is based on consent, you can withdraw at any time

8. Data security

We apply organisational and technical security measures to protect personal data against unauthorised access, alteration, disclosure or destruction. These include:

• all traffic between pigmenta.ee and the underlying services is TLS 1.2+ encrypted
• photo files move directly from your browser to Hetzner Object Storage over an encrypted channel (S3 signed PUT)
• the database lives on a protected Hetzner server and is only reachable on the internal network
• Pigmenta employees have access strictly on a need-to-know basis
• all third parties (Hetzner, LHV, Cloudflare, Twilio, Google) hold their own security and compliance certifications (ISO 27001, SOC 2, GDPR compliance)

9. Changes to this privacy policy

Pigmenta may amend this privacy policy from time to time — for instance when a new processor is added, when the law changes or when the service evolves. We notify customers of significant changes by email at least 14 days before they take effect.
